US Court Mandates Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.

In her order, the court noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Case

The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.

The court, who was hearing his petition to removal in a Maryland district court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
